ISLAMABAD: The counsel for Dr AQ Khan and detained Pakistani woman in the US Dr Aafia Siddiqui has announced to lodge an FIR against ex-president Pervez Musharraf and the Quaid of Pakistan Muslim League-Nawaz (PML-N) Mian Nawaz Sharif at a police station of Islamabad on Thursday (tomorrow).

Barrister Javed Iqbal Jaffery told The News that Gen (retd) Pervez Musharraf had handed over Dr Aafia Siddiqui and many other Pakistanis to the US and he would lodge an FIR against him on 26-02-2009 at 3 pm. He said he knew that the police would not register the FIR against the ex-president but he would move the Islamabad High Court against the refusal of the police, which would order the police to lodge the FIR.

Responding to a question, Jaffery replied: “I am hundred per cent hopeful that the Islamabad High Court would order the police to lodge the FIR against Musharraf.”Regarding Mian Nawaz Sharif, Barrister Jaffery said the Supreme Court was attacked during the Nawaz Sharif tenure. He said though time changes man but how could Nawaz Sharif beat the drum of independent judiciary now.

He said he was the counsel for Amil Kansi who was executed in the US after being handed over to the Americans by Nawaz Sharif and said, “I have a bundle of letters of Amil Kansi in which he has alleged that Nawaz Sharif had handed him over to America.”

About Dr Aafia Siddiqui he said, “The Pakistan Embassy just has to write one letter to the International Court of Justice, asking it to shift the case of Dr Aafia from New York to the ICJ as Dr Aafia was a Pakistani citizen and was arrested in Afghanistan and how could she be tried in the US.”

The lawyer added, “The ICJ could never turn down any such application when two countries claim right on same person or thing.” He said had the government of Pakistan written the letter on shifting the case of Dr Aafia Siddiqui to the ICJ in July 2008, the matter would have been different now.

About the humiliation of notorious strip and search meted out to Dr Aafia Siddiqui in a jail in New York and about the release of her pictures on the Youtube website Barrister Jaffery said had Aafia’s case been shifted to the ICJ, no such humiliation could have happened. About lodging of an FIR against Pervez Musharraf, Barrister Jaffery repeatedly said: “Someone has to bell the cat.” He said those responsible for the violation should be brought to justice and if he would not take a step forward, then who else would dare.

LAHORE: The prime minister has offered to make the deposed chief justice head of the constitutional court, insiders in the PML-N told Dawn on Tuesday.

Prime Minister Yousuf Raza Gilani made the offer during a meeting with Punjab Chief Minister Shahbaz Sharif on Monday, the insider said.

The Charter of Democracy (CoD) envisaged the setting up of such a court to adjudicate on matters requiring interpretation of the constitution.

According to sources, the PML-N is in a dither over the timing of the lawyers’ sit-in, slated for March 16— four days after the beginning of the long march.

The PML-N has reportedly asked lawyers leadership to extend the date by at least two weeks – a concession lawyers are not ready to accept.

According to party insiders, two factors had forced the PML-N to drag its feet on the sit-in issue. The party wants to derive maximum political mileage from the extended long march and provide more time to Prime Minister Yousuf Raza Gilani to deliver on promises he made to Shahbaz Sharif on Monday.

In another development, a ‘guest’ from Saudi Arabia met Nawaz Sharif at his Raiwind residence on Tuesday night.

Meeting between PML-N chief and guest was kept secret and most party leaders did not know any thing about it.

Some party leaders named the guest as Shaikh Saeed, according to them, even the personal staff of the former prime minister was not allowed to enter the room during meeting.

Sources said that some PML-N leaders met lawyers’ leaders in Islamabad and tried to persuade them to extend the date for sit-in.

The PML-N was of the view that it would be really hard for party workers to start the march on March 12 and reach Islamabad in four days – on March 16. They said the party workers needed some more time to reach Islamabad.

The lawyers’ leaders, however, were not ready to ‘let any political party call the shorts’ as it was their own movement.

They did not agree to extend the date. However they assured PML-N leaders to take up the matter with their central leadership.

According to the party insiders, Chief Minister Shahbaz Sharif told Prime Minister Yousuf Raza Gilani that the PML-N would not make any demand over the next four years if Chief Justice Iftikhar Mohammad Chaudhry was restored to his position.

The sources said that Tuesday’s PML-N request to lawyers was an outcome of the meeting between prime minister and the chief minister.

They said the PML-N now wanted to give more time to the prime minister by postponing the sit-in, but keeping political pressure on through long march.
